     WASHINGTON (Reuters Health) - The Bush Administration has appointed a new general counsel at the US Food and Drug Administration (FDA) in a move that eventually may prove more significant than the appointment of a new commissioner.

    According to one source, the appointment of Daniel Troy signifies that the FDA may at least back-off several recent policy initiatives, including the agency's stated belief that it has the statutory authority to force brand name drug manufacturers to switch their prescription drugs to the over-the-counter (OTC) market.

    The FDA made that assertion after it was petitioned by the Blue Cross and Blue Shield insurance provider WellPoint Health Networks Inc. of California to force the OTC switch of Schering-Plough's allergy drug Claritin (loratadine), as well as Aventis' Allegra (fexofenadine) and Pfizer's Zyrtec (Cetirizine).

    As a private attorney, Daniel Troy successfully challenged FDA regulations aimed at restricting the dissemination of information about unapproved uses of prescription drugs, while representing the non-profit legal group the Washington Legal Foundation (WLF). At the time, Troy was a partner at the Northern Virginia-based law firm Wiley, Rein & Fielding, where he specialized in First Amendment law.

    But the significance of his appointment may be even greater than his alleged conservative interpretation of federal regulations.

    The appointment returns the general counsel post to a political appointment for the first time in more than a decade. As a result, sources say, Troy will most likely also serve as a liaison between the Bush Administration and the FDA, while the search continues for a new FDA commissioner.

    The FDA has been without a commissioner since Dr. Jane E. Henney resigned from the position in January.

    Under federal regulations, the general counsel primarily is responsible for representing the FDA in both court proceedings and administrative hearings. Some of the top issues currently facing the agency include cloning, food labeling, tobacco regulation and international trade.

    The division is headquartered in Rockville, Maryland, and has about 60 attorneys on staff.

    Troy is a graduate of Columbia Law School. Prior to becoming a partner at Wiley, Rein & Fielding, he served as a special assistant to Friends of Giuliani, a group formed to support New York City Mayor Rudolph W. Giuliani during his aborted run for the Senate, and as a lecturer at Columbia Law School., 百拇医药
