A few days ago, a panel discussion on the subject of "Acts for managing medical accidents and malpractice" was held in Beijing.
The related leading members of the Chinese Society of hospital administration, the Chinese physician's association, the Chinese society of health and law, and the Ministry of Health gathered together with the representatives of local medical circle, the jurists, and the press circles for learning, publicizing, carrying out, and fulfilling the "Acts for managing medical accidents and malpractice" in order to come up with new and better ways to put into practice of the acts. The persons who attended the meeting expressed that to deal with medical dispute, prevention should be considered as a priority. The right of the patients should be observed and respected clearly and during the course of medical management, the idea of human sympathy with the patient as the center and an enhanced legal awareness are required from the medical workers. The learning and putting into effect of the "acts" will play an important role in legally defending activities of the Chinese medical profession at large.
The representatives from the medical circle considered that the practice of this new "acts" brought people to an innovated stage of having "rules" at hand to solve the medical disputes; simultaneously, they also made useful investigations on the new "acts" and the related problems for solution of medical disputes.
The responsible person at the bureau of medico-legal expertise of Ministry of Health disclosed that the accessory documents to the "acts for managing medical accidents and malpractice" will soon be released. They include "the pattern of recognition of responsibility of malpractice", "supervision of medical technical appraisement", "acts of medical records management", "temporary acts of reporting malpractice and important errors in medical practice", "the professional standard of autopsy involved with dispute of malpractice and the relevant technical problems", "the measures taken for responsibility conformity of fault medical behaviors in malpractice".
