摘要：目的 通过对药物咨询过程中可能涉及的法律问题的分析，探讨药师在进行药物咨询服务时所要注意的权责关系。方法 通过对药物咨询进行分类，对各种咨询模式下所涉及的法律问题进行分析。结果 无论是收费咨询还是免费咨询，面对面咨询还是非面对面咨询，口头咨询或书面咨询，这些行为本质上都属于医疗行为，咨询提供方都应遵守相关诊疗规范，尽到合理指导义务，避免过错的发生。结论 药师作为咨询提供方在转型期需要在提高自身专业素质的同时强化服务意识和法律意识，也希望国家能够尽快出台《药师法》为药学服务提供保障和依据。
