风险预防与社会共治:食品安全立法的范式革新及制度重构

     摘 要:新时代背景下,我国食品安全立法正经历从传统“政府主导型”监管转向“风险预防与社会共治”两大核心范式转型的过程,但从“安全底线”到“健康优先”的立法逻辑亟待转变,立法协同性与执行效能面临现实挑战,法律体系碎片化、基层执法效能不足、企业自我规制缺位等问题突出,因此应完善风险预防机制,构建协同治理制度,强化企业自我规制的法治激励,推动食品安全治理从“被动应对”向“主动防控”转型,为现代化治理体系提供法理支撑。

    Abstract: In the new era, China’s food safety legislation is undergoing a transformation from the traditional “government-led” regulatory model to one centered on “risk governance and social collaborative governance”. However, the legislative logic needs to shift from “safety baseline” to “health priority”. There are challenges such as insufficient legislative coordination, poor enforcement effectiveness, legal system fragmentation, inadequate grassroots enforcement, and missing corporate self-regulation. To address these, we should improve risk prevention mechanisms, build collaborative governance systems, strengthen legal incentives for corporate self-regulation, and move food safety governance from “passive response” to “active prevention”, providing legal support for modern governance.
